Who it's for

  • You are named executor in a will, or you are applying to be appointed, for someone who lived in Victoria.
  • You are doing this for the first time and want the legal deadlines and the order of the work in one place.
  • You want to keep clear records for the beneficiaries and, where required, for the Supreme Court of Victoria, Probate Office.
  • You may also be working with a lawyer and want to stay organised and keep costs under control.

How the documents work together

  1. Read the user guide first: it explains the role, the route and the deadlines, and tells you which file to use at each step.
  2. Enter the date of death in the workbook. Each legal deadline then appears with its due date, legal basis and official link.
  3. Send the notification letters from the three template files and log each one in the Contacts and Letters tab.
  4. Record every asset, debt, receipt and payment in the workbook. The estate account balance is checked against your bank balance.
  5. When the waiting periods have passed and debts are dealt with, the Distributions tab works out each beneficiary's entitlement and the receipt form closes the loop.

Route check

Not every estate in Victoria needs the full court process. These are the routes the guide explains:

RouteWhen it may apply
No grant (informal administration)No real estate held solely or as tenant in common, and each asset holder agrees to release funds without a grant (often for small amounts with no complications, conditions may apply).
Small estates optional serviceA grant is needed, the estate is below the small estate limit ($137,210 for deaths between 1 July 2026 and 30 June 2027; the limit changes each financial year), the application is simple, and the applicant is the executor named in the will or the next of kin if there is no will.
Grant of probateThere is a valid will naming an executor who applies, and a grant is needed.
Letters of administration (with or without the will annexed)There is no valid will, or the executor cannot or will not apply.

Check the current threshold on the official source before relying on a simplified route.

What's not included

  • Legal advice on your situation, or answers to questions about a specific estate.
  • Official court or tax forms: they are free on the official websites, and the guide links to them.
  • Filing, submitting or checking documents for you.
  • Tax calculations for your estate: the workbook records the amounts you obtain from the tax authority or your adviser.

Questions about this kit

Do I need a lawyer to act as executor in Victoria?

No lawyer is required. The Court lists applying yourself as an option and says many people apply on their own. For contested applications the Probate Office cannot advise and legal advice is encouraged. The guide's section on professional help lists situations where speaking to a lawyer is wise.

Is there a simpler process for small estates in Victoria?

Small estates optional service: A grant is needed, the estate is below the small estate limit ($137,210 for deaths between 1 July 2026 and 30 June 2027; the limit changes each financial year), the application is simple, and the applicant is the executor named in the will or the next of kin if there is no will. The Probate Office helps prepare the paperwork, places the advertisement and prepares the affidavit for you to sign; its role ends when the grant issues. You can still choose to prepare and file it yourself through RedCrest. The route check in the guide compares every route, with its legal basis and official source.

Which deadlines does the Victoria workbook calculate?

The workbook calculates every statutory deadline in the guide from the dates you enter, including: Family provision application deadline (6 months from the appointment or grant); Earliest distribution protected from family provision claims (6 months from the appointment or grant). Federal deadlines are included too.
