Who it's for

  • You are named estate trustee in a will, or you are applying to be appointed, for someone who lived in Ontario.
  • You are doing this for the first time and want the legal deadlines and the order of the work in one place.
  • You want to keep clear records for the beneficiaries and, where required, for the Superior Court of Justice, at the court office in the county or district where the deceased lived at the time of death.
  • You may also be working with a lawyer and want to stay organized and keep costs under control.

How the documents work together

  1. Read the user guide first: it explains the role, the route and the deadlines, and tells you which file to use at each step.
  2. Enter the date of death in the workbook. Each legal deadline then appears with its due date, legal basis and official link.
  3. Send the notification letters from the three template files and log each one in the Contacts and Letters tab.
  4. Record every asset, debt, receipt and payment in the workbook. The estate account balance is checked against your bank balance.
  5. When the waiting periods have passed and debts are dealt with, the Distributions tab works out each beneficiary's entitlement and the receipt form closes the loop.

Route check

Not every estate in Ontario needs the full court process. These are the routes the guide explains:

RouteWhen it may apply
No certificate neededThe assets can be collected without a court certificate, for example assets with a named beneficiary or jointly owned assets that pass automatically to the other owner, or institutions that agree to release assets without one.
Small Estate CertificateThe estate is valued at $150,000 or less (threshold in force since 1 April 2021).
Certificate of Appointment of Estate Trustee (full probate)The estate is valued at more than $150,000 and an institution or the land registry requires a certificate.

Check the current threshold on the official source before relying on a simplified route.

What's not included

  • Legal advice on your situation, or answers to questions about a specific estate.
  • Official court or tax forms: they are free on the official websites, and the guide links to them.
  • Filing, submitting or checking documents for you.
  • Tax calculations for your estate: the workbook records the amounts you obtain from the tax authority or your adviser.

Questions about this kit

Do I need a lawyer to act as estate trustee in Ontario?

A lawyer is not legally required to apply for a certificate or administer an estate in Ontario. Court staff cannot give legal advice. A lawyer is recommended for complex matters such as disputes, contested wills, dependant support claims, spousal elections or a motion about a bond. The guide's section on professional help lists situations where speaking to a lawyer is wise.

Is there a simpler process for small estates in Ontario?

Small Estate Certificate: The estate is valued at $150,000 or less (threshold in force since 1 April 2021). The applicant files Form 74.1A with Form 74.1B and a draft Form 74.1C certificate (plus will affidavits if there is a will) with the Superior Court of Justice, and pays Estate Administration Tax. The route check in the guide compares every route, with its legal basis and official source.

Which deadlines does the Ontario workbook calculate?

The workbook calculates every statutory deadline in the guide from the dates you enter, including: File the Estate Information Return with the Ministry of Finance (180 days from the appointment or grant); Surviving married spouse elects between the will (or intestacy) and an equalization of net family property (6 months from the date of death); Do not distribute the estate without the spouse's written consent or a court order (6 months from the date of death); Dependant's support claim against the estate (6 months from the appointment or grant). Federal deadlines are included too.
