Who it's for

  • You are named executor in a will, or you are applying to be appointed, for someone who lived in New York.
  • You are doing this for the first time and want the legal deadlines and the order of the work in one place.
  • You want to keep clear records for the beneficiaries and, where required, for the Surrogate's Court in the county where the deceased had their primary residence.
  • You may also be working with an attorney and want to stay organized and keep costs under control.

How the documents work together

  1. Read the user guide first: it explains the role, the route and the deadlines, and tells you which file to use at each step.
  2. Enter the date of death in the workbook. Each legal deadline then appears with its due date, legal basis and official link.
  3. Send the notification letters from the three template files and log each one in the Contacts and Letters tab.
  4. Record every asset, debt, receipt and payment in the workbook. The estate account balance is checked against your bank balance.
  5. When the waiting periods have passed and debts are dealt with, the Distributions tab works out each beneficiary's entitlement and the receipt form closes the loop.

Route check

Not every estate in New York needs the full court process. These are the routes the guide explains:

RouteWhen it may apply
Small estate (voluntary administration)The deceased left personal property with a gross value of $50,000 or less, not counting property set off for the family under EPTL 5-3.1(a).
Probate (there is a will)There is a will and the estate is not handled as a small estate (a probate petition may also be filed even when personal property is under $50,000).
Administration (no will)There is no will and personal property is above the small estate limit (or a full proceeding is otherwise needed, for example a possible wrongful death claim).

Check the current threshold on the official source before relying on a simplified route.

What's not included

  • Legal advice on your situation, or answers to questions about a specific estate.
  • Official court or tax forms: they are free on the official websites, and the guide links to them.
  • Filing, submitting or checking documents for you.
  • Tax calculations for your estate: the workbook records the amounts you obtain from the tax authority or your adviser.

Questions about this kit

Do I need a lawyer to act as executor in New York?

The court offers a Small Estate DIY form program for self-represented filers. For probate, CourtHelp says that in many cases it might be a good idea to get a lawyer because probate can be complicated; it also suggests a real estate attorney where real property is involved. The guide's section on professional help lists situations where speaking to an attorney is wise.

Is there a simpler process for small estates in New York?

Small estate (voluntary administration): The deceased left personal property with a gross value of $50,000 or less, not counting property set off for the family under EPTL 5-3.1(a). The executor (if there is a will) or the closest distributee files a small estate affidavit in the Surrogate's Court. The route check in the guide compares every route, with its legal basis and official source.

Which deadlines does the New York workbook calculate?

The workbook calculates every statutory deadline in the guide from the dates you enter, including: File New York estate tax return (Form ET-706) and pay any New York estate tax (9 months from the date of death); File the Inventory of Assets form with the Surrogate's Court (9 months from the appointment or grant); Creditor claims period: after this point the fiduciary is protected for good-faith payments already made (7 months from the appointment or grant); Surviving spouse serves and files notice of election to take the elective share (6 months from the appointment or grant). Federal deadlines are included too.
