Who it's for

  • You are named executor in a will, or you are applying to be appointed, for someone who lived in California.
  • You are doing this for the first time and want the legal deadlines and the order of the work in one place.
  • You want to keep clear records for the beneficiaries and, where required, for the Superior Court of California.
  • You may also be working with an attorney and want to stay organized and keep costs under control.

How the documents work together

  1. Read the user guide first: it explains the role, the route and the deadlines, and tells you which file to use at each step.
  2. Enter the date of death in the workbook. Each legal deadline then appears with its due date, legal basis and official link.
  3. Send the notification letters from the three template files and log each one in the Contacts and Letters tab.
  4. Record every asset, debt, receipt and payment in the workbook. The estate account balance is checked against your bank balance.
  5. When the waiting periods have passed and debts are dealt with, the Distributions tab works out each beneficiary's entitlement and the receipt form closes the loop.

Route check

Not every estate in California needs the full court process. These are the routes the guide explains:

Questions about this kit

Do I need a lawyer to act as executor in California?

A personal representative may handle probate without a lawyer and can hire one or pay for a consultation; lawyer fees are paid from the estate. However, California courts hold that a non-lawyer executor cannot appear in propria persona on behalf of the estate in matters outside the probate proceedings (for example a civil lawsuit for the estate), and the courts have left open whether self-representation is allowed for estate matters within the probate case where others' interests are affected. The guide's section on professional help lists situations where speaking to an attorney is wise.

Is there a simpler process for small estates in California?

Small estate affidavit (personal property): the probate estate in California is worth $208,850 or less (deaths on or after April 1, 2025; $184,500 for deaths from April 1, 2022 to March 31, 2025) and at least 40 days have passed since the death; debts are not subtracted when valuing. The person entitled to the property signs an affidavit and gives it, with a certified death certificate, to whoever holds the property (for example a bank). No court case is opened. The route check in the guide compares every route, with its legal basis and official source.

Which deadlines does the California workbook calculate?

The workbook calculates every statutory deadline in the guide from the dates you enter, including: Deliver the original will to the Superior Court clerk (30 days from the date of death); Wait before using the small estate affidavit (40 days from the date of death); Notify the State Director of Health Care Services (Medi-Cal) (90 days from the appointment or grant); Mail notice of administration (DE-157) to each known creditor (4 months from the appointment or grant). Federal deadlines are included too.
